Please read the Terms of Service
carefully before using or obtaining any materials, information or
services through this site. We offer access to the use of our site
subject to your acceptance of these terms and your agreement to
observe them. 4 Fold Creations, Inc. reserves the right to change
the contents of the Terms of Service without notice from time to
time, and the amended agreement will be posted on the iUpdateIt
site. If you continue to use our iUpdateIt site after such changes
take place, you will be automatically subject to the revised Terms
of Service.
Content Ownership and Copyright
4 Fold Creations, Inc. is the sole owner of the copyright and the
contents of the iUpdateIt site, therefore you may NOT copy,
reproduce, transfer or change any of the data, information or
displays, without written permission from 4 Fold Creations, Inc. While we do not claim any intellectual property rights over the
material you provide on your website, 4 Fold Creations, Inc.
reserves the right to refuse or remove any content that violates in
any way the Terms of Service you agree to uphold.

In order to use our site you
must be 18 years of age or older, and have the ability
to enter into binding contracts if you should decide to
become a paid account holder. |

legal name, valid email address and any other
information needed to expedite the sign-up process, such
as credit card information or billing address. |

iUpdateIt offers two types
of accounts: free account and paying account, the last
one offering several levels to accommodate individual
users and/or re-sellers. |

Accounts registered by
automated methods are not permitted. |

You are responsible for
maintaining the secrecy of your password, login and
account information and understand that you are
financially responsible for your use of the site and/or
the use of the site by anyone using your password.

You are responsible for the
integrity of the content posted under your account and
login information, and/or for the content that any other
person posts using your password or reseller account.

No more than ONE free
account may be maintained by any given person or legal
entity.

You may not use this service
to post, or transmit any illegal material that could
constitute or encourage a violation of the law,
including the laws in your jurisdiction, as well as
copyright laws. |

| Your account will be terminated if
any of these conditions are violated, and you understand and agree
that the service provided by 4 Fold Creations, Inc. and its site
iUpdateIt, will be used at your own risk, since 4 fold Creations,
Inc. cannot be held responsible for unlawful and/or improper use of
the site. Privacy Policy
When you use our site you are subject
to our
Privacy Policy. By accepting our Terms of Service, you understand and agree to the
information provided in the
Privacy
Policy and accept it as well.
Payments and Refund Policy
iUpdateIt offers a thirty day free trial for all accounts. You can
opt for a free account or a registered paying account, in which case
we will need full authorization to bill at the time of registration.
After this free trial period, should you choose not to cancel the
service, we will automatically charge the credit card number you
provided us upon registration. This credit card number is required
on all paying accounts, for which we assure complete privacy. (see
Privacy Policy). Our billing takes place on a monthly
basis on your signup day for the following month of usage.
iUpdateIt does not offer any refunds nor pro-rated fees for days
not used. If you should cancel your
subscription before the end of your billing period, we shall not bill you
again until further notice. When we do not receive notification to
the contrary, we assume that you want to continue your service and
will charge you for the following thirty day period.
Changes to Fees or Services
Our services are billed in advance and
do not include taxes, duties or levies. You will be responsible for
payment of any taxes except for federal or state taxes (in the
United States). Non recurring charges, such as set up, activation or
installation fees will be included in your first bill.
You have the option at any time to upgrade or downgrade your chosen
plan, and your credit card will be billed accordingly at the
beginning of the following billing cycle. During this process,
you will also have to agree by agreeing to the Terms of Service
while making changes to
your account. Please note that a downgrade in your service plan will
cause loss of content and capacity of your account. If you choose to
downgrade, please be advised that 4 Fold Creations, Inc. does not
accept any liability for the loss. 4 Fold Creations, Inc. reserves
the right at any given time, and from time to time to change, or
discontinue temporarily or permanently the service without notice. Current subscription fees may be subject to change upon a 30 day
notification from us, which will be be posted on the iUpdateIt site
as well.
Cancellation of Service
Account holders are responsible for closing their own accounts.
Please note the link offered for this purpose. Only by using this
link will your account be officially closed. No emails or other
forms of communication will be accepted in order to cancel your
service. Upon closing, all content will be deleted from your account
and you are solely responsible for the removal of iUpdateIt boxes
from any websites. If you cancel before the end of your billing
period, your account will be considered closed and you will not be
billed again until further notice by you. Note that should you
choose to renew your service, you would have to go through the sign
up process again. 4 Fold Creations, Inc. reserves the right, without
advance notice nor liability, to terminate your account and the
right to refuse service to anyone at any time.

You are responsible for the
content of your account/accounts whether they may be an
individual account, or multiple accounts held by a
reseller. |

You agree that when you
transmit post or submit any content, images, or data
using our service you have the legal right to do so, and
that your use of such data does not violate the
copyright trademark laws or any third party rights.

4 fold Creations, Inc. may
remove, however is not obligated to, the content and
accounts that violate the Terms of Service of its
iUpdateIt site and will terminate such accounts with no
refund.

You may not post any spam
nor transmit, any viruses, worms, or destructive codes,
nor use any device, software or routine that interferes
or attempts to interfere with the normal operation of
our site.

You are responsible for
obtaining consent from you customers to release their
personal information before entering such persons
information into our system.

You may not transfer or
assign this agreement, or your right and obligations
under it to any other person.

Note that our sites may
contain links to other sites which we do not operate nor
control. We provide these for your convenience and do
not approve, nor disapprove the contents in such other
sites, nor do they indicate an association with the
owner/ operator of any of these other sites.

We will make the effort to
keep our site available 24/7 except for necessary
scheduled maintenance time, or unscheduled maintenance
time or system outages. Your access to our site may not
be uninterrupted or available at all times, and any loss
of income due to down time is not our liability.

site will be error free, that such errors will be
corrected, or that our site will be free from viruses or
other possibly harmful components. |

not be liable for your loss of data at any time.

Installation
If you choose to have 4 Fold Creations, Inc. install an
iUpdateIt box into a website, you will be asked to supply FTP access
information for your server. This information will be secured in a
reasonable manner, but 4 Fold Creations, Inc. is not responsible for
the transmission, loss or theft of this data.
4 Fold Creations, Inc. reserves the right to refuse installation
service to anyone at any time. While we take reasonable precautions,
websites can be complicated and during the installation process it
is possible that the functionality of a webpage or website may be
broken or contain errors. 4 Fold Creations, Inc. is not responsible
or liable for any interruption of service and does not warrant that
the functions contained in these webpages or the Internet website
will meet the client's requirements or that the operation of the
webpages will be uninterrupted or error-free.
Resellers
All resellers are completely responsible
for the management, support, and customer service for their users.
Resellers are also responsible and liable for all of the content
that their users post within their iUpdateIt boxes. Any reseller or
user of a reseller that violates copyright infringement or posts
content that is derogatory, pornographic, has hate speech, or any
other content that is not suitable for the general public, will
constitute a violation of our Terms and will be subject to immediate
deactivation of the resellers accounts.
Authorization to Bill for Account
Holders
You authorize 4 Fold Creations, Inc. to charge your credit card for
the amount submitted each time you want to use this method of
payment. By checking the appropriate box, you indicate to us that
you agree to the charge and to the monthly fee applicable to your
chosen level of service. |
